In July 2023, a $20 million administrative blunder saw 2,000 early childhood centres accidentally paid a duplicated 4% funding increase. The Ministry let them keep it. Unusual? Yes. But it exposes a brutal truth: the ECE funding system is a high-volume, error-prone cash flow machine—and when it breaks against you, there is no mercy.

The Audit Trigger

The auditor does not need a whistleblower. They have the RS7 Return, the wash-up schedule, and the Funding Handbook’s recovery provisions. Funding is paid three times a year (March, July, November) as an advance of 75% of projected funded child hours (FCHs), followed by a “wash-up” that reconciles against actual attendance. If your occupancy drops mid-cycle, the advance looks inflated. The wash-up crystallises the clawback. A 10 FCH loss per day for under-2s—funded at $14.56 per hour from January 2026—equals roughly $35,000 in annual revenue. The Ministry’s dedicated monitoring team flags any service where actual FCHs fall materially below the advance. They do not need to prove intent. They just need the numbers.

The Regulatory Hook

The ECE Funding Handbook is issued under section 548(5) of the Education and Training Act 2020. Its conditions are not guidance—they are law. The Act links Ministry funding directly to compliance with the Handbook and the Licensing Criteria for Centre-Based ECE Services 2008 (specifically GMA7 on professional practices). Failure to maintain accurate records to the required standard means the Ministry can determine that no funding is payable, in full or in part. Worse, debts outstanding for 30 days can be offset against future funding before GST, gutting cash flow. The recovery rules are administrative, not judicial. There is almost no ERA case law on clawbacks because the Ministry does not sue—it just stops the cheque.
